This article analyzes one of the main juridical problems arising from assisted reproduction techniques: to determine affiliation of the newborn and the way our judges of the Republic has used to solve this conflict in specific cases of surrogacy, donor-assisted insemination, and post-mortem insemination, bearing in mind that, unlike the biological affiliation, consent of gamete donors and recipients is a mandatory element to determine parenthood.
