The present text tries to be part of the modern criminal law doctrine around the ways of realization of the type. The aim is to demonstrate by means of the structural analysis of the philosophy and the precepts of the objective imputation that there is a third way of realizing the criminal type, apart from the action and the omission. Emphasizing the methodology, the research was outlined theoretically through the use of the hermeneutic paradigm, taking as a starting point the historical and philosophical study of the topic. It seeks to lay the foundations for this new theory to emerge, since the important thing is to do doctrinal development of the subject in question, which is the interruption of the Third party remedial actions. In this sense, the aforementioned methodology yielded a result of new knowledge in the matter.
