Abstract

BEDOYA BEDOYA, María Rocío; GUTIERREZ LONDONO, Daniela; OCAMPO PARIAS, Brahiam Santiago  and  BELTRAN PEREZ, Juan Camilo. The Union Contract in Colombia: Uses, Effects and Winners. Opin. jurid. [online]. 2022, vol.21, n.44, pp.151-178.  Epub Mar 19, 2022. ISSN 1692-2530.  https://doi.org/10.22395/ojum.v21n44a8.

The objective of this writing is to present final results of the investigation that analyzes the uses and effects of the union contract in Colombia. To obtain these results, the documentary research was combined with the analysis of the union contract in Leonisa from the qualitative method and the analysis of the databases provided by the Ministry of Labor and the National Union School through the quantitative method, which allowed to elucidate the great impact of this institution in the Colombian health sector, in the last 9 years. As empirical work, two focus groups with workers from Leonisa and eight semi-structured interviews with union leaders and workers in the health sector were carried out. The results of the investigation reveal that the sector most affected by the union contract is the public health sector. As a preliminary conclusion, it is stated that the big winners with the growing use of the union contract in Colombia are the employers who frequently use it as a business strategy, to hire cheap and precarious labor in order to save labor costs, and also the union leaders that are functional to this strategy in exchange for particular benefits.

Keywords : union contract; illegal labor intermediation; job insecurity; Colombia.
