In the middle of an update and reform process, the Cuban judicial order recognized within the the Cuban legal order the existence of medium-sized, small and micro enterprises, which led to questioning if the current working legislation, desgined for a different scenario, is prepared to face this new reality. With that purpose, this article analyzed the regulation of the employment contract in Cuba for engaging the challenges that must be faced to rule the working relationships within the micro, small and medium-sized enterprises. The use of scientific research methods such as the analysis-synthesis, the inductive-deductive, the historical-judicial and the exegetic-analytic ones allowed the systematization of the evolution of policies in the country regarding the non-State economic actors an with this in mind examining the challenges of the regulation of the emplymewnt contract for adapting to the particularities of the micro, small and medium-sized enterprises in the nation without disprotecting the workers rights.
