Abstract

The Attorney General's Office may suspend, terminate or waive criminal prosecution, for showing the possibility of applying the principle of opportunity; Starting from the question: Does the application of the principle of opportunity in the processes of adolescents demobilized from armed conflict is a postulate of the minimum criminal law or criminal policy that generates criminal impunity ?, was asked about the legal reasons - leading to social judicial officials to apply the principle of opportunity in criminal proceedings of adolescents demobilized from the armed conflict preferably a type explanatory research was performed, qualitative approach, the results are explained in this article research Primary techniques were used, including interviewing the Family Advocate Valledupar intervening in some of the selected processes also use secondary techniques such as literature review. Heeding the interview technique it was used as the survey instrument and for the texts used index cards. Aiming the research carried out, the analysis of several criminal prosecutions of adolescents demobilized from the armed conflict in Colombia was obtained in the case of these teenagers the opportunity principle applies preferentially, which must lead to the conclusion that in the processes of adolescents is not mentioned eminently criminal law sanctioning the instrument that inspires the administration of justice, but the principle of minimum intervention, where the criminal law is the last resort of the social policy of the State to protect the goods applies legal.
