The objective of this research was to problematize from the philosophy the concept of forgiveness and reconciliation within the framework of transitional justice in Colombia, which was the result of the Final Peace Agreement signed between the Colombian State and the former FARC-EP. To achieve this analysis, a qualitative methodological approach was implemented, based on theoretical philosophical and jurisprudential sources that seek to account for the mechanisms of restorative justice in Colombia, specifically, the practical relationship that memory and truth have for an ontology of forgiveness. As a result of the process, the philosophical and legal problematization of the concept of forgiveness was obtained as that device that is in constant dispute in the framework of the post-conflict between the sovereignty of the State as an imperium subject and popular sovereignty as that right to forgive that can only emanate from civil society in general from the truth to the victims.
