This article develops the educational special needs in chilean law as a criterion for determining the best interests of the child or adolescent in the context of the right to education. The subject will be approached from an analytical and dogmatic perspective, in order to propose the construction of the so-called best interest, taking into account the special educational requirements of children and adolescents, particularly in cases of autism spectrum disorder. The above, taking into consideration the relevance and advantages offered by the principle already mentioned, since it allows to adapt it to each reality and particular case.
