The purpose of this work is to analyze the main problems suffered by the penitentiary system in Mexico, such as overcrowding, lack of social rehabilitation of inmates, regulatory dispersion, inappropriate and insufficient infrastructure, institutional corruption, self-government, clandestine operations, systematic violations of human rights, among others, which have led to its collapse and degradation. Through qualitative inferential analyzes, the penitentiary scheme in Mexico is scrutinized from a socio-legal perspective, evidencing the imminent need for an ontological transformation, with restorative schemes updated in accordance with the current reality. Using a qualitative-inductive method, proposals and perspectives for viable solutions that can help improve this social institution are examined. At the end of this article, different proposals and perspectives are presented for the viable implementation of a solution that contributes to the improvement of this social institution.
