The violation of Ecuatorian sovereignty by the Colombian government in March 2008 raised Bellum Preventivum to a reason of State, eliminated political crime, and increased flaws in the right of asylum. However, the urgency of overcoming the social armed conflict through political negotiation led to the approval of the Marco Jurídico para la Paz (Legal Framework for Peace) and the creation of Transitional Justice. In the process, and hand in hand with the concept of Law, the Victim arose as a political actor. The criminal court’s vigilance takes the memory of the Jewish genocide, Shoah, his a point of reference. This result of the civilized barbarity of modernity has become a civic religion which covers the Western humanitarian conscience.
