This article presents the first results of the work done in the framework of the investigation "Responsibility of the Colombian State for constituent acts and constitutional reform-Analysis from the Political Constitution of 1991 and International Human Rights Instruments", whose objective is to determine the responsibility of the Colombian State when the powers that be constitutional reform cause wrong full injury, affecting legally protected interests and preex-isting in the Constitution of 1991, in international human rights standards on the principle of equality be for republic burdens. The article, result of a qualita-tive research of a legal nature, explanatory, descriptive and documentary, will show that in Colombia, in accordance with Article 90 of the Constitution, in accordance with the paths marked by constitutional principles and norms of international law, I tis predicable State responsibility for the damages wrong full resulting from the exercise of the power to amend the Constitution by the constituted power. The titles of imputation on which can be held responsibility of state are, as will be shown, the special damage and these service failure
