PAREDES MOSQUERA, Hoover Hugo; OROZCO ORDONEZ, Maria Andrea y JIMENEZ RODRIGUEZ, Lady Mabel. The history of disciplinary law in Colombia and the practice of law: an analysis of national law unification. Justicia [online]. 2021, vol.26, n.40, pp.188-205. Epub 23-Feb-2022. Objective:
This paper analyzes the evolution of the Disciplinary Regime in Colombia from a historical and substantive perspective, with an emphasis on its constitutional origin, the identification of relevant aspects of disciplinary normative unification, and a review of the transformation of the legal regime within the practice of law in Colombia.
Method:
a qualitative approach was employed that used documentary analysis of regulations enacted between the years 1811 to 2020 in Colombia. which over time strengthened the autonomy of local disciplinary law.
Results:
several significant changes in disciplinary actions were evidenced, which evolved from being exclusively sanctioning, to ones that protected the needs of the State with a greater guarantee of human dignity and due process.
Conclusions:
we identified that the practice of law originated as an empirical exercise that with time evolved into a normativized and regulated profession with several statutes and regulations applied to it.
