This article analyzes transnational corporate or white-collar crime by examining the case of fraud involving prostheses of a French company used in breast implants in women, especially in Latin America. It succinctly describes the related case and judicial decisions, as well as the victims subjected to the fraudulent procedures cultural context. It then presents a theoretical framework for this type of criminality and explores the conditions that promote impunity for the perpetrators of these crimes. The article demonstrates how, among other causes, the shortcomings of international law and the status of those who commit these crimes favor impunity and the victims’ vulnerability. Finally, it offers some conclusions and proposals to address this problem.
