This article analyzes the contents of Note 5-4-M/147 dated May 23, 1986, sent by the Embassy of Peru to the Chilean Chancellery, known as the “Bákula Memorandum.” The document is significant because it is the first diplomatic communication that raises the absence of a specific treaty on maritime boundaries. The aim is to examine those paragraphs of the memorandum that allude to the Chilean-Peruvian debate on the nature of the 1952 Declaration of Santiago and the 1954 Special Maritime Frontier Zone Agreement. Although the primary objective of the Bákula Memorandum was to start negotiations, Chile’s failure to reply made it the cornerstone of Peru’s international lawsuit at The Hague.
