Resumen
ACEVEDO ESPINOLA, Luis. Amicus Curiae, Democratic Principle and Participation in Environmental Matters. Opin. jurid. [online]. 2022, vol.21, n.45, e4. Epub 14-Jun-2024. ISSN 1692-2530. https://doi.org/10.22395/ojum.v21n45a4.
The present work seeks to link the institution of the amicus curiae with the right of access to justice and environmental participation, and to contrast this with the Chilean reality. The methodology that will be used is dogmatic and analytical in the light of International Law, to finally contrast the results with the Chilean reality. It is concluded that the amicus curiae is an aspect that develops the principle of a democratic State and, in the environmental case, develops the right to environmental participation, forming part of the right. In the Chilean case, its development is incipient, since it is only recognized in contentious-administrative environmental matters, but not in the other ways.
