Fundamental human rights, emanating from the very nature of the human, being require shelter by the State. Life and health, together with liberty and human dignity, are rights of the supreme kind of fundamental rights, all of them being interconnected. In this paper we try to demonstrate the passing from the right to life through the public health services and its transit to the transformation into a right of fundamental kind sheltered by the statutory health bill, and thus deduct if this statutory health bill represents the fundament for guaranteeing it. This paper approaches two fundamental aspects: 1) The transit of health care from being a service to become a fundamental human right according to the jurisprudence of the Constitutional Court. 2) An analysis of the new statutory health bill in order to evaluate if this bill is the best solution for the Colombian health service.
