This article explains the context and the importance of one of the most important rulings emitted by the German Federal Constitutional Court, emphasizing the "irradiation effect" as expression of a culture that gives prevalence to fundamental rights over other legal aspects. Additionally it refers to the distinction among principles and rules which enable the construction of certain methods of interpretation.
