In this article the author argues about the difcult question concerning the normative status of social rights. Is analyzed if those rights are strictly speaking basic rights or if, as is argued for some critics, are merely aspirations of the society. The social rights fundamental character is defended on the basis of a description that demonstrates the existence of continuity between basic rights and social rights. Because of that, is sustained that is possible to show that both kind of rights constituted a system. It's pointed out that social rights lack of efciency (in Mexico, as well as in some important parts of Latin-Americans societies) cannot attribute to some anomaly. Instead, this is due to transgression of the serial or lexical order that dene the system of the basic rights.
