The central thesis of this article is that the results of peace negotiation, conceived in strategic rationality, depend on factors that cannot be guaranteed. The author refers to emotional states as influencing factors: compassion, shame, indignation, or resentment. Because of their structure and cognitive content, these emotions must be kept in mind if one purports to achieve lasting peace. The article in divided into three parts. One, a description of the emotions based on Elster’s reflections in Rationality and the Emotions (1996) and Strong Feelings: Emotion, Addiction and Human Behavior (1999), with the objective of specifying the role that emotions play in making practical decisions. Two, it describes the general characteristics of the current peace negotiation in Colombia, based on criteria that allow this to be classified as an accord of instrumental rationality (in the Hobbesian sense). Three, it assesses the possible effects that awareness or ignorance of the emotions could have on rational negotiation, in particular the efficacy and validity of the legal considerations that guide the negotiation process.
