The trial structure, the functions of the judge, the binding effect of judicial decisions and their foundations in the imperium and the iurisdictio have been arguments in the working interest of Roman law tradition and the science of procedural law; this contribution reviews the effects of the sentence in the structure of Roman civil procedure, the functions of the judge and the origin of the appeal, and then compare the analysis with an overview of the effects of legal proceedings and decisions in Argentina's procedural law.
