PADILLA SANCHEZ, JORGE ALBERTO. Blockchain and Smart Contracts. Approach to their Legal Problems and Challenges. Rev. Derecho Privado [online]. 2020, n.39, pp.175-201.  Epub 31-Out-2020. ISSN 0123-4366.  https://doi.org/10.18601/01234366.n39.08.

The development of blockchain and distributed ledger technologies has allowed the creation of new forms of self-execution of contractual obligations through the so-called "smart contracts". The characteristics of the blockchain, that is, its code language, disintermediation, autonomy and immutability, create new problems associated with contractual execution through smart contracts; and, at the same time, they imply challenges for the actors involved, as well as for the regulators. The purpose of this article is to introduce the analysis of the problems associated with blockchain and smart contracts.

Palavras-chave : blockchain; distributed ledger techonologies; smart contracts; self-enforcement; contractware.
