The text reconstructs the Inter American Development Bank state reform and modernization strategy since the 90's decade, from the tensions that began with the institutional transformation process promoted by this organism and that pretends the sustainability of a development model based on the market by the simultaneous pursuit of democratic governance. This reconstruction moves to the judicial reform, conceived as one of the main components, and from the analysis of a significant sample of programs and countries of the region, argues that although it contains components to strengthen both democracy and the market, its orientation obeys to promote mainly the market. The proposed analysis pretends to contribute to the investigations about the impacts of the judicial reforms in the region and gives some elements to the comprehension of the Inter American Development bank judicial reform agenda in Colombia making a brief reconstruction of the context in which those programs where implemented and the tensions that went through the constitutional process of the 90's.
