This article tries to reflect the need for structuring a procedural juridical science which can guarantee the application of basic rights throughout the process and, especially, during a sentence, as the most relevant procedural act. The need for a reasonable and practical speech becomes evident in a social right state in which people's basic rights are protected and judges are demanded to exercise a judicial activity which goes beyond a simple application of norms in the search for dispensing justice.
