This article analyzes Cross-Border Insolvency regulations in one of Colombia's largest trade Partners: Chile. The Chilean Law has not accepted UNCITRAL Model Law, and therefore the lack of legal harmonization, which in turn makes them harder to regulate. In addition, its internal legislation is based on anachronism and protectionism - in clear contrast to international trends. Moreover, they do not abide by any international treaty that regulates Cross-Border Insolvency accurately. This research paper is developed in the framework of the Research Group Contemporary Problems of Law and Politics (GIPCODEP) from the University of San Buenaventura, Cali District and constitutes results of the research project called "UNCITRAL: A Study of International Regime Border Insolvency in Latin America".
