This article presents final results coming from a socio-juridical research work following a descriptive-analytical methodology. The problem area outlines the context of the effectiveness of the participation concerning the urban surplus value in the municipality of Manizales-Colombia. First, an approximation to the notion of urban surplus value is made. The main theoretical references on the subject in relation to the processes of the city and the causes that originate it are also described. Second, the actions and operations of the municipality of Manizales participating in surplus value are identified; besides, meaningful backgrounds in the city are registered. Third, the analysis is focused on the effectiveness of legality and legitimacy, which demands from the State not only a regulatory function, but also a policy in terms of the causes and purposes that define its application. Finally, it is concluded that the fulfillment of a norm is neither exhausted in the regulatory function of a State, nor in the legal dispositions that reach a formal content with criterion of validity. Efficiency has a social purpose, and this is only observed in the material fulfillment of a norm whose level of reach is achieved observing the judgment value that supports and justifies its purpose.
