This article presents the evolution of the legal institution of concubinage from the cultures of antiquity, more than 4000 years old, e. g. Mesopotamia, Rome up to the present day. For this purpose, a comparative doctrinal, legislative, and jurisprudential analysis is carried out, considering that what underlies concubinage is a de facto relationship or cohabitation society and that, nevertheless, it is considered to be an institution generated by economic issues. Therefore, based on the etymological and grammatical meaning of concubine, this term is outrageous for women, since it discriminates against them and violates their right to human dignity. Consequently, this research aims to find out why concubines are still referred to as such, given that, since the decade of the 21st century, there has been more progress and recognition of human rights, which has had an impact on the expansion of women's rights, freedom, and equality.
