The text addresses the legal problem regarding the scope of land use planning guidelines, determination of land use and occupation scenarios, and land use plans concerning the power of land use regulation of municipal and district councils in Colombia. In this sense, the central thesis is that the scope of such development planning instruments limits and encroaches on the land use regulation power of municipal and district councils since, through the departmental land use plans and the guidelines for the regulation of the territories of the departments, land use, and occupation scenarios would be determined, which means that the exercise of the constitutional power of municipalities and districts to define land use would be conditioned.
