Abstract
SUAREZ LOPEZ, Beatriz Eugenia and FUENTES CONTRERAS, Édgar Hernán. RIGHT TO RECOGNITION OF LEGAL PERSONALITY. CONCEPT AND DEVELOPMENT IN THE CASE LAW OF THE INTER-AMERICAN COURT OF HUMAN RIGHTS. Prolegómenos [online]. 2015, vol.18, n.36, pp.65-80. ISSN 0121-182X. https://doi.org/10.18359/dere.934.
The right to recognition of legal personality has been addressed by the Inter-American Court of Human Rights in many decisions; establishing its importance for the benefit of other rights enshrined in the American Convention on Human Rights. This article addresses the case law development of that right within the decisions of the international court in order to determine the content of its protection and the liabilities of the States around it. To do this, the so-called census method, is used as a method to collect the case laws being analyzed; the results are presented in three different sections, including conceptualization, uses in the judgment of the proposed tribunal and the challenges that should arise before the right under study.
Keywords : Recognition of legal personality; case law line; forced disappearance; indigenous and tribal communities; Inter-American Court of Human Rights.
